All homeowners are required to comply with the Covenants, Conditions & Restrictions (CC&Rs) of Benton Woods HOA. These documents are legally binding and were established to maintain property values and quality of life in our community.

Covenants, Conditions & Restrictions
Purpose
The CC&Rs establish the legal framework for the Benton Woods Homeowners Association and set forth the rights and obligations of all property owners within the community.
Key Provisions
- All properties are subject to annual assessments (currently $175)
- Architectural modifications require prior approval from the HOA Board
- Properties must be maintained in good condition
- Commercial activities are restricted in residential areas
- Common areas are for the use and enjoyment of all residents
Annual Dues & Assessment Policy
Annual Assessment
Amount: $175 per year per household
Due Date: January 1st of each year
Late Fee: $25 if not paid within 30 days

Use of Funds
Annual dues are used for:
- Common area maintenance and landscaping
- Street lighting electricity costs
- Insurance for common areas
- Administrative expenses
- Reserve fund for future improvements
Architectural Control Guidelines
Prior Approval Required
The following modifications require HOA approval before beginning work:
- Exterior paint color changes
- Fence installation or modification
- Shed or outbuilding construction
- Major landscaping changes
- Driveway modifications
- Solar panel installation
- Exterior lighting additions
Submission Process
- Submit detailed plans to the HOA Board
- Include drawings, colors, materials, and dimensions
- Allow 30 days for review and response
- Obtain written approval before starting work

Property Maintenance Standards
Homeowner Responsibilities
- Maintain lawn and landscaping in neat condition
- Keep exterior of home in good repair
- Remove trash containers from view except on collection day
- Prevent accumulation of debris or junk
- Maintain driveways and walkways
- Trim trees and bushes that overhang sidewalks
Prohibited Items
- Inoperable vehicles visible from the street
- Commercial vehicles parked overnight (except service vehicles)
- Temporary structures without approval
- Excessive outdoor storage
Parking Regulations
Street Parking
- Overnight street parking is discouraged
- Do not block mailboxes or driveways
- Large vehicles and RVs must not be parked on streets
Driveway Parking
- Boats, RVs, and trailers should be stored out of view when possible
- Commercial vehicles with signage should be garaged
- All vehicles must be currently registered and operable
Pet Policies
General Rules
- All pets must be registered with Mecklenburg County
- Dogs must be leashed when outside of owner's property
- Owners must immediately clean up after pets
- Excessive barking or noise must be controlled
- No more than 3 pets per household (reasonable number)
Prohibited
- Livestock or farm animals
- Dangerous or exotic animals
- Commercial breeding operations
Enforcement Procedures
Violation Process
- First Notice: Friendly reminder letter
- Second Notice: Formal violation notice with 30-day cure period
- Third Notice: Final notice with potential fine assessment
- Continued Violation: Legal action may be pursued
Appeals Process
Homeowners have the right to appeal violations by:
- Requesting a hearing with the HOA Board
- Presenting their case at the next board meeting
- Submitting written documentation supporting their position
